Intellectual Property is the branch of Public Law that contains regulations to protect everything that concerns the creations produced by the human mind. It is the discipline that protects original literary, artistic or scientific creations expressed in a tangible or intangible medium or support.<\/p>\n\n\n\n
INTELLECTUAL PROPERTY DIVISION<\/strong><\/p>\n\n\n\n This legal discipline is divided into two branches: Copyright and Intellectual Property. This concept is defined like this when it is fundamentally spoken of from an economic and patrimonial point of view. However, it is not taken into account that Intellectual Property is also considered a human right that constitutes a fundamental category of rights of the person as such, which must be distinguished from other rights that may also appear in the law but that do not constitute human rights.<\/p>\n\n\n\n INTELLECTUAL PROPERTY AS A HUMAN RIGHT<\/strong><\/p>\n\n\n\n Thus, we can say that Intellectual Property is a right inherent to the human person. It is for this reason that when a company hires someone, and in particular a researcher, it takes the precaution that said person assigns the rights that could derive from any invention or scientific or technical innovation that the former makes.<\/p>\n\n\n\n At this point, speaking in terms of a Human Right, reference must be made to the primacy of the common interest or over private interests, it is equally valid when considering the Industrial Property Law as a human right that arises from the first paragraph of the article of the Universal Declaration of Human Rights which textually states:<\/p>\n\n\n\n \u201cEVERYONE HAS THE RIGHT TO ENJOY THE ARTS AND TO PARTICIPATE IN SCIENTIFIC PROGRESS AND THE RESULTING BENEFITS\u201d.<\/p>\n\n\n\n From there we can rescue the irrefutable fact that Intellectual Property has a capital social importance, because it protects the rights of creators in the artistic, scientific, literary, as well as commercial scientific fields. Its social importance is given taking into account that, from every point of view, it protects the consumer in terms of the services and products they consume, granting them the identification of their origin and quality.<\/p>\n\n\n\n SOCIAL AND BUSINESS IMPORTANCE OF INTELLECTUAL PROPERTY<\/strong><\/p>\n\n\n\n We also verified the social importance of Intellectual Property, because by protecting the intangible assets of any company and becoming an incentive for authors, creators, entrepreneurs and businessmen to continue creating and innovating, which also translates into technological development that benefits the entire society as a whole.<\/p>\n\n\n\n The business importance of Intellectual Property is given because it is effectively the legal branch that provides protection to trademarks, patents, industrial designs, industrial models and related creations of any company. Thus, thanks to it, it is possible to identify when a product is original or a copy, providing precise information to the consumer about who is the creator or applicant of an intangible asset. On the other hand, the rules of Intellectual Property, give the creators of intangible assets, exclusivity in their use and exploitation, as a fair recognition of the work done.<\/p>\n\n\n\n Any creation that is made of a company can become an economic income and that is the moment in which Intellectual Property becomes a company asset. Thanks to these assets that become intellectual capital, companies can gain relevance and a competitive advantage over other market agents. Thus, the entrepreneur has the possibility of entering to compete even at a regional, national and regional level, undoubtedly providing a guarantee to the consumer of the products or services that contain it. Today where innovation is taking place in all areas and new businesses, companies and ventures are proliferating, it is of vital importance that entrepreneurs, businessmen and all business owners protect Intellectual Property through their various categories. In this way, they will prevent their ideas, effort and work from being misused and misappropriated.<\/p>\n\n\n\n It should be emphasized then that resorting to the protection granted by Intellectual Property, in short, will make it easier for any company to be more competitive and to be able to better manage the risks generated by the market, making it difficult for its intangible assets to be violated by third parties.<\/p>\n\n\n\n INTELLECTUAL PROPERTY IN BOLIVIA<\/strong><\/p>\n\n\n\n In Bolivia, the regulatory framework for this matter is made up of Law 1392 on Copyright, and Decision 351 of the Andean Community of Nations. While in the field of Industrial Property, there is the Industrial Privileges Law of December 1916, the Trademark Regulatory Law of January 1918 and Decision 486 of the Andean Community, a rule that is currently applied in its entirety.<\/p>\n\n\n\n The entity in charge of ensuring and granting Intellectual Property Rights is the National Intellectual Property Service. This entity of a decentralized nature of the Central Power, fulfills its role in accordance with the regulations that currently govern the matter in this regard. However, this fact, it is evident that, despite this, unfortunately and due to not having the mechanisms and regulations complementary, this institution of the State, does not manage to grant a clear legal certainty to all national and foreign holders in the protection of their rights.<\/p>\n\n\n\n Apart from this, it must be recognized that, in our country, unfortunately, we do not have an adequate culture of Intellectual Property, due to the lack of awareness and education about the capital importance of this said weakness and lack. It must be addressed by institutions such as SENAPI, more now than ever, due to the advances in technology and the constant innovations that are taking place at every moment. Based on this reality, it is imperative that massive awareness and education campaigns be carried out, not only in the business and entrepreneurial world, but in the social sphere in general. Es por esta raz\u00f3n que cuando una empresa contrata a alguien y en particular a un investigador, toma la precauci\u00f3n que esa persona, le ceda los derechos que podr\u00edan derivarse de cualquier invento o innovaci\u00f3n cient\u00edfica o t\u00e9cnica que aqu\u00e9lla realice.<\/p>\n\n\n\n En este punto, hablando en materia de un Derecho Humanos, se tiene que hacer referencia a la primac\u00eda del inter\u00e9s com\u00fan o sobre los interese particulares, es igualmente valido al considerar el Derecho de Propiedad Industrial como derecho humano que surge del p\u00e1rrafo primero del art\u00edculo de la Declaraci\u00f3n Universal de los Derechos Humanos que textualmente se\u00f1ala:<\/p>\n\n\n\n \u201cTODA PERSONA TIENE DERECHO A GOZAR DE LAS ARTES Y A PARTICIPAR EN EL PROGRESO CIENTIFICO Y EN LOS BENEFICIOS QUE DE EL RESULTEN\u201d.<\/p>\n\n\n\n De ah\u00ed podemos rescatar el hecho irrefutable que la Propiedad Intelectual, tiene una capital importancia social, porque protege los derechos que, de los creadores en los campos cient\u00edficos art\u00edstico, cient\u00edfico literario, as\u00ed como en el comercial. Su importancia social, est\u00e1 dada tomando en cuenta que, desde todo punto de vista, protege al consumidor en cuanto a los servicios y productos que consume, otorg\u00e1ndole la identificaci\u00f3n de su origen y calidad.<\/p>\n\n\n\n IMPORTANCIA SOCIAL Y EMPRESARIAL DE LA PROPIEDAD INTELECTUAL<\/strong><\/p>\n\n\n\n Verificamos tambi\u00e9n, la importancia social de la Propiedad Intelectual, porque al proteger los bienes intangibles de toda empresa y constituirse en un incentivo para autores, creadores, emprendedores y empresarios para seguir creando e innovando, lo que se traduce asimismo en desarrollo tecnol\u00f3gico que beneficia a toda la sociedad en su conjunto.<\/p>\n\n\n\n La importancia empresarial de la Propiedad Intelectual, est\u00e1 dada porque efectivamente es la rama jur\u00eddica que brinda protecci\u00f3n a las marcas, patentes, dise\u00f1os industriales, modelos industriales y creaciones vinculadas de toda empresa. Es as\u00ed que, gracias a ella, se identifica cuando un producto es original o copia, brindando la informaci\u00f3n precisa al consumidor sobre quien es el creador o solicitante de un bien intangible. Por otra parte, las normas de Propiedad Intelectual, les dan a los creadores de bienes intangibles, la exclusividad en su uso y explotaci\u00f3n, como un justo reconocimiento al trabajo realizado.<\/p>\n\n\n\n Toda creaci\u00f3n que se haga de una empresa, puede convertirse en un ingreso econ\u00f3mico y es ah\u00ed el momento en el que la Propiedad Intelectual, se convierte en un activo empresas. Gracias a esos activos que se convierten en capital intelectual, las empresas pueden ganar relevancia y una ventaja competitiva frente a los otros agentes del mercado. Tiene as\u00ed el empresario, la posibilidad de entrar a competir inclusive a nivel regional, nacional y regionalmente, brindando sin lugar a dudas una garant\u00eda al consumidor de los productos o servicios que la contienen. Hoy en d\u00eda donde la innovaci\u00f3n se va dando en todos los \u00e1mbitos y que se van proliferando nuevos negocios, empresas y emprendimientos, es de vital importancia que los emprendedores, empresarios y todos los due\u00f1os de negocios, protejan la Propiedad Intelectual a trav\u00e9s de sus diversas categor\u00edas. De esa manera, evitaran que sus ideas, esfuerzo y trabajo realizado sea objeto de mal uso y apropiaci\u00f3n indebida.<\/p>\n\n\n\n Se debe enfatizar entonces que el acudir a la protecci\u00f3n que otorga la Propiedad Intelectual, en definitiva, facilitar\u00e1 que toda empresa sea m\u00e1s competitiva y pueda gestionar de mejor forma los riesgos que genera el mercado, haciendo que sea dif\u00edcil que sus activos intangibles sean vulnerados por terceros.<\/p>\n\n\n\n LA PROPIEDAD INTELECTUAL EN BOLIVIA<\/strong><\/p>\n\n\n\n En Bolivia el marco normativo de esta materia, est\u00e1 compuesto por la Ley 1392 de Derecho de Autor, y la Decisi\u00f3n 351 de la Comunidad Andina de Naciones Mientras que el campo de la Propiedad Industrial, se tiene a la Ley de Privilegios Industriales de diciembre del 1916, la Ley Reglamentar\u00eda de Marcas de enero 1918 y la Decisi\u00f3n 486 de la Comunidad andina, norma que es la que hoy se aplica en toda su extensi\u00f3n.<\/p>\n\n\n\n El ente encargado de velar y conceder los Derechos de Propiedad Intelectual es el Servicio Nacional de Propiedad Intelectual. Esta entidad de naturaleza desconcentrada del Poder Central, cumple su rol de acuerdo a las normas que hoy rigen la materia al respecto, No obstante, ese hecho, resulta evidente que, pese a ello, lamentablemente y debido a no contar con los mecanismo y normas complementarias, esta instituci\u00f3n del Estado, no llegue a otorgar una clara seguridad jur\u00eddica a todos los titulares nacionales y extranjeros en la protecci\u00f3n de sus derechos.<\/p>\n\n\n\n Fuera de ello, se debe reconocer que, en nuestro pa\u00eds, lamentablemente, no tenemos, una adecuada cultura de Propiedad Intelectual, debido a la falta de concientizaci\u00f3n y educaci\u00f3n sobre la capital importancia que tiene esta dicha debilidad y carencia. Debe ser encarada por las instituciones como SENAPI, m\u00e1s ahora que nunca, debido a los avances de la tecnolog\u00eda y las innovaciones constantes que se est\u00e1n dando a cada momento. Partiendo de esa realidad, es imperativo que se realicen campa\u00f1as masivas de concientizaci\u00f3n y de educaci\u00f3n, no solo en el mundo empresarial y del emprendimiento, sino en el \u00e1mbito social en general. Esto con el fin que el consumidor y la sociedad en su conjunto, tenga conocimiento de c\u00f3mo se pueden proteger los productos del intelecto, para que no sea enga\u00f1ada con productos y servicios que no son los originales y que todos sean advertidos de lo los da\u00f1os que puede sufrir el consumidor, consumiendo productos falsos, as\u00ed como el enorme perjuicio que ocasiona el adue\u00f1arse de trabajo ajeno.<\/p>\n\n\n\n Sin lugar a dudas, un problema realmente serio que existe en Bolivia es la edici\u00f3n abusiva de libros, software, m\u00fasica y otros.
