The following characteristics are common to them: they are works produced by craftsmen, entirely by hand or with the aid of hand tools or the use of mechanical means, provided that the direct manual contribution of the craftsman remains the most important element of the finished product; they are representations or expressions symbolizing the craftsman's culture; they are works comprising a wide range of products made from raw materials; their distinctive characteristics may be utilitarian, aesthetic, artistic, creative, culturally linked, decorative, functional, traditional, symbolic, and religiously and socially significant; there are no special restrictions on the quantity of production and no two pieces are exactly alike. Other characteristics that can be applied to \u201ctraditional crafts\u201d include the fact that they are passed down from generation to generation and that they are linked to a local indigenous community.<\/p>\n\n\n\n<p>From an IP perspective, handicrafts have three distinct elements: reputation, derived from their style, origin or quality; external appearance, their shape and design; and know-how, the expertise and knowledge used to create and manufacture the handicraft products. Each element may be protected by a different form of IP. Know-how, for example, may be protected by patents or as a trade secret; external appearance may be protected by copyright or industrial designs, while reputation may be protected by product or service marks, collective or certification marks, geographical indications or unfair competition law.<\/p>\n\n\n\n<p>Traditional crafts require techniques, skills and know-how and traditional knowledge that are often of considerable antiquity and are passed down from generation to generation. Handicraft products may constitute traditional cultural expressions through their design, appearance and style, and may also embody traditional knowledge through the skills and know-how used to produce them. Traditional Knowledge and Traditional Cultural Expressions, including handicraft products, are valuable cultural, social and historical assets of the communities that maintain, practice and develop them; they are also economic assets that can be used, traded or licensed to generate income and foster economic development. Unfortunately, however, traditional techniques and the design, reputation and style associated with handicrafts are open to imitation and misappropriation. Too often, cheap imitations damage sales of traditional crafts and the quality reputation of genuine products.<\/p>\n\n\n\n<p>Proposals and solutions are being put forward for the legal protection of Traditional Knowledge and Traditional Cultural Expressions in order to prevent their misuse or misappropriation or other kinds of illicit exploitation. It is also possible to use these solutions for the protection of traditional craftsmanship. Several countries and regions have also developed their own sui generis systems for the protection of TK and TCEs. Meanwhile, artisans and craft organizations can also use IP rights, such as trademarks, geographical indications, copyright, industrial designs or patents, to promote their interests. Specifically, such rights can be used to protect traditional crafts against unauthorized reproduction and adaptation, and against misleading use of their style and reputation.<\/p>\n\n\n\n<p>As shown above, the field of Intellectual Property is so broad to the extent that human creativity, with the support of scientific and technological knowledge, has reached the generation of new intellectual creations susceptible of protection. And not only in the realization of scientific, literary and artistic works, or industrial designs or utility models, but inventions have also reached the biological part, for example, with the achievement of new plant varieties, or the invention of new seeds. Hence, over time, there have been subfields of protection: Copyright and Industrial Property, to accentuate the regulatory specificity according to the different characteristics of each creation.<\/p>\n\n\n\n<p>In Bolivia, especially in the Altiplano area, the most representative handicraft fair is the ALASITAS FAIR. Declared by UNESCO Intangible Cultural Heritage of Humanity, the Alasita, an Aymara word that in Spanish means \u201cbuy me\u201d, is a deeply rooted tradition especially among the Aymara population of the Andes, which over time has spread to other regions. It is also known as the \u201cfeast of abundance\u201d. <em>aymara<\/em> que en castellano significa \u201cc\u00f3mprame\u201d, es una tradici\u00f3n muy arraigada especialmente entre la poblaci\u00f3n <em>aymara <\/em>de los Andes, que con el tiempo se ha extendido a otras regiones. Tambi\u00e9n es conocida como \u201cfiesta de la abundancia\u201d.<\/p>\n\n\n\n<p>The Alasita Festival lasts for approximately three weeks. Visitors buy miniatures of all kinds of household items: money, cars, houses, construction materials, clothing, appliances, food, etc., which attendees entrust to the Ekeko, so that in the course of the year they become reality. The fair is characterized by the miniature objects that are elaborated and manufactured by artisans of the city of La Paz, mainly, who, year after year, respond to the needs and demands of the population to produce new \u201cwishes\u201d; traditionally, miniature banknotes and food baskets so that they do not lack during this time.<\/p>\n\n\n\n<p>La palabra \u201cAlasitas\u201d es una palabra <em>aymara<\/em> The word \u201cAlasitas\u201d is an Aymara word meaning \u201cbuy me\u201d, and the Ekeko is the god of abundance in Bolivian Andean and Altiplano mythology. According to historians, the celebration of the Alasitas becomes more visible since 1781, when Jos\u00e9 Sebasti\u00e1n de Segurola (Governor Intendant of La Paz) ordered to celebrate a feast in honor of the deity called Ekeko (God of Abundance), in gratitude, since the city overcame the indigenous encirclement of Tupac Katari.<\/p>\n\n\n\n<p>It is precisely this fair where the work of the artisans is clearly expressed with their works, works that undoubtedly must be protected, as crafts are protected in other countries, taking care to preserve our cultural traditions expressed in immense traditional knowledge. This is where the relationship between handicrafts and the rules contained in the Intellectual Property and OTHER PROVISIONS must be reflected. Such protection is provided for in the Crafts Promotion and Development Law of 2012, the Copyright Law of 1992 and the Cultural Heritage Law of 2014.<\/p>\n\n\n\n<p>Taking into account that the native products of each country should be a source of quality of life for its inhabitants and should be shown to the world, either through craft fairs, such as ALASITAS or promotional mechanisms, their work is an excellent engine for generating jobs, promoting the economic development of countries. However, in our environment, despite having provisions that protect and guarantee their work, it lacks a proper incentive by the authorities and, currently, due to the economic crisis facing our country, their needs were forgotten. Apart from this, it can be seen that the intellectual protection of the artisans' works is very weak, putting at risk their real consideration as Bolivian cultural value. Entre otras caracter\u00edsticas que se pueden aplicar a la \"artesan\u00eda tradicional\" figura el hecho de que se transmite de generaci\u00f3n en generaci\u00f3n y de que est\u00e1 vinculada a una comunidad ind\u00edgena local.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Desde la perspectiva de la P.I., la artesan\u00eda posee tres elementos bien diferenciados: reputaci\u00f3n, derivada de su estilo, origen o calidad; apariencia externa, su forma y dise\u00f1o; y saber hacer, la pericia y los conocimientos utilizados para crear y fabricar los productos de artesan\u00eda. Cada elemento puede estar protegido por una forma distinta de P.I. El saber hacer, por ejemplo, puede estar protegido por las patentes o en calidad de secreto comercial; la apariencia externa puede recibir protecci\u00f3n mediante el derecho de autor o los dibujos o modelos industriales, mientras que la reputaci\u00f3n puede protegerse por medio de las marcas de producto o de servicio, las marcas colectivas o de certificaci\u00f3n, las indicaciones geogr\u00e1ficas o la legislaci\u00f3n sobre competencia desleal.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>La artesan\u00eda tradicional requiere t\u00e9cnicas, capacidades y conocimientos especializados y tradicionales que a menudo son de considerable antig\u00fcedad y se transmiten de generaci\u00f3n en generaci\u00f3n. Los productos artesanales pueden constituir expresiones culturales tradicionales por medio de su dise\u00f1o, apariencia y estilo, y tambi\u00e9n pueden plasmar conocimientos tradicionales mediante las capacidades y los conocimientos especializados utilizados para producirlos. Los Conocimientos Tradicionales y las Expresiones Culturales Tradicionales, incluidos los productos artesanales, constituyen valiosos activos culturales, sociales e hist\u00f3ricos de las comunidades que los mantienen, practican y desarrollan; asimismo, son activos econ\u00f3micos que pueden ser utilizados, comercializados o cedidos en licencia para generar ingresos y fomentar el desarrollo econ\u00f3mico. Sin embargo, por desgracia, las t\u00e9cnicas tradicionales y el dise\u00f1o, la reputaci\u00f3n y el estilo vinculados a la artesan\u00eda est\u00e1n expuestos a la imitaci\u00f3n y a la apropiaci\u00f3n indebida. Con demasiada frecuencia, las imitaciones baratas perjudican las ventas de la artesan\u00eda tradicional y la reputaci\u00f3n de calidad de los productos genuinos.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Se est\u00e1n planteando propuestas y soluciones para la protecci\u00f3n jur\u00eddica de los Conocimientos Tradicionales y las Expresiones Culturales Tradicionales a fin de impedir su uso o apropiaci\u00f3n indebidos u otra clase de explotaci\u00f3n il\u00edcita. Asimismo, es posible utilizar esas soluciones para la protecci\u00f3n de la artesan\u00eda tradicional. Varios pa\u00edses y regiones han desarrollado asimismo sus propios sistemas sui generis para la protecci\u00f3n de los CC.TT. y las ECT. Mientras tanto, los artesanos y las organizaciones de artesan\u00eda tambi\u00e9n pueden utilizar los derechos de P.I., como las marcas, las indicaciones geogr\u00e1ficas, el derecho de autor, los dibujos y modelos industriales o las patentes, para promover sus intereses. Concretamente, se pueden utilizar esos derechos para proteger la artesan\u00eda tradicional contra la reproducci\u00f3n y la adaptaci\u00f3n no autorizadas, y contra el uso enga\u00f1oso de su estilo y reputaci\u00f3n.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Como se mostr\u00f3 anteriormente, el campo de la Propiedad Intelectual es tan amplio en la medida en que la creatividad humana, con el apoyo del conocimiento cient\u00edfico y tecnol\u00f3gico, ha llegado a la generaci\u00f3n de nuevas creaciones intelectuales susceptibles de protecci\u00f3n. Y no s\u00f3lo en la concreci\u00f3n de obras cient\u00edficas, literarias y art\u00edsticas, o de dise\u00f1os industriales o modelos de utilidad, sino que los inventos han llegado tambi\u00e9n a la parte biol\u00f3gica, por ejemplo, con el logro de nuevas variedades vegetales, o el invento de nuevas semillas. De ah\u00ed que con el tiempo se hayan dado los subcampos de protecci\u00f3n: el Derecho de Autor y la Propiedad Industrial, para acentuar la especificidad normativa de acuerdo con las diversas caracter\u00edsticas de cada creaci\u00f3n.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>En Bolivia, m\u00e1s que todo en el \u00e1rea del Altiplano, la feria m\u00e1s representativa de artesan\u00eda es dada por la FERIA DE ALASITAS. Declarada por la UNESCO Patrimonio Cultural Inmaterial de la Humanidad, la Alasita, una palabra <em>aymara<\/em> que en castellano significa \u201cc\u00f3mprame\u201d, es una tradici\u00f3n muy arraigada especialmente entre la poblaci\u00f3n <em>aymara <\/em>de los Andes, que con el tiempo se ha extendido a otras regiones. Tambi\u00e9n es conocida como \u201cfiesta de la abundancia\u201d.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>La Fiesta de la Alasita se extiende por el lapso de aproximadamente tres semanas. Los visitantes compran miniaturas de toda clase de elementos del hogar: dinero, autom\u00f3viles, casas, materiales de construcci\u00f3n, ropa, electrodom\u00e9sticos, comida, etc., que los asistentes encomiendan al Ekeko, para que en el transcurso del a\u00f1o se conviertan en realidad. La feria se caracteriza por los objetos en miniatura que son elaborados y fabricados por artesanos de la ciudad de La Paz, principalmente, que, a\u00f1o tras a\u00f1o, responden a las necesidades y demandas de la poblaci\u00f3n para producir nuevos \u201cdeseos\u201d; tradicionalmente, los billetes en miniatura y los canastones de alimentos para que no falten durante este tiempo.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>La palabra \u201cAlasitas\u201d es una palabra <em>aymara<\/em> que significa \u201cc\u00f3mprame\u201d, y el Ekeko es el dios de la abundancia en la mitolog\u00eda boliviana andina y del altiplano. Seg\u00fan los historiadores, el festejo de las alasitas se hace m\u00e1s visible desde 1781, cuando Jos\u00e9 Sebasti\u00e1n de Segurola (Gobernador Intendente de La Paz) orden\u00f3 celebrar una fiesta en honor a la deidad denominada Ekeko (Dios de la Abundancia), con motivo de agradecimiento, ya que la ciudad se sobrepuso al cerco ind\u00edgena de T\u00fapac Katari.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Es precisamente esta feria donde se expresa n\u00edtidamente el trabajo de los artesanos con sus obras, obras que indudablemente deben ser protegidas, como es protegida la artesan\u00eda en otros pa\u00edses, teniendo el cuidado de preservar nuestras tradiciones culturales expresadas en inmensos conocimientos tradicionales. Es ah\u00ed donde se debe reflejar la relaci\u00f3n entre las artesan\u00edas y las normas contenidas en la Propiedad Intelectual y OTRAS DISPOSICIONES. Esa protecci\u00f3n est\u00e1 prevista en la Ley de Promoci\u00f3n y Desarrollo Artesanal de 2012, la Ley de Derecho de Autor de 1992 y la&nbsp;&nbsp; Ley del Patrimonio Cultural de 2014.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Teniendo en cuenta que los productos aut\u00f3ctonos de cada pa\u00eds deben ser fuente de calidad de vida para sus habitantes y deben ser mostrados al mundo, ya sea mediante ferias artesanales, como Las ALASITAS o mecanismos de promoci\u00f3n, constituyendo su trabajo un excelente motor generador de empleos, promoviendo el desarrollo econ\u00f3mico de los pa\u00edses. Sin embargo, en nuestro medio, pese a contar con disposiciones que protegen y garantizan su trabajo, carece de un debido incentivo por parte de las autoridades y, actualmente, por la crisis econ\u00f3mica que enfrenta nuestro pa\u00eds, sus necesidades fueron olvidadas. Aparte de ello, se puede apreciar que la protecci\u00f3n intelectual de las obras de los artesanos es muy d\u00e9bil, poniendo en riesgo su real consideraci\u00f3n como valor cultural boliviano.
